Product Liability

Each year in Florida, thousands of people are seriously injured or killed by dangerous or defective products.

When manufacturers and distributors sell products to the general public, those products should be safe and function properly for their intended uses. When a product manufacturer does not design a product safely or without regard to applicable standards, or they fail to warn the consumer of any possible harm, the outcome can be devastating. If you or a loved one were hurt by a defective product, you may be able to receive damages.  We are dedicated to ensuring innocent people harmed by the dangerous products. Contact us today to discuss your rights.

Although public product recalls attempt to get products off the market and out of homes before anyone is injured, many defective and dangerous products are not identified until serious injury or wrongful death occurs.

Types of Defective Products

Florida residents expect to be provided with safe products, but this does not always happen. Physical injuries can be suffered from a variety of products. Some include:

  • Electronics
  • Automobiles and auto parts
  • Children’s toys and furniture
  • Medications and medical devices
  • Household products

There are three main types of product defects:

Design defect:

The outcome of a poor product design, or a design that does not take into account accepted safety standards.

Failure to warn:

When products do not contain adequate warnings on their labels and packaging, revealing any possible safety hazards, consumers can become injured.

Manufacturing defect:

Product defects that take place in the manufacturing process.

Defective electronics

Defective electronics are sometimes limited to simply not working.  Sometimes, though, they can be dangerous, leading to electric shocks or fires.  The level of damages will depend on the extent of the defect.

Defective pharmaceuticals

Patients are subject to faulty prescription and over-the-counter medications. Although the FDA tests pharmaceuticals for safety and effectiveness, the approval studies are often too small and too short to detect many dangers, and often hints of potential injury in premarket studies are ignored until a drug is taken by millions and thousands are hurt.  Drug companies and doctors are often so eager for a new remedy or miracle cure that they promote or adopt new drugs and turning a blind eye to the potential for harm.

Many people do not hesitate when purchasing store-bought herbal remedies. However, these are not approved by the Food and Drug Administration (FDA).  Rarely do they have any proven effectiveness, but in most cases, they are at least harmless.  Other times, though, they can pose a serious health risk.

Some common serious injuries resulting from faulty products and prescriptions include:

  • Burn injuries
  • Brain injuries
  • Quadriplegia or paralysis
  • Amputation
  •  Wrongful death
